Justice Binta Nyako of the Federal High Court in Abuja has ruled against the request made by Nnamdi Kanu, the detained leader of the Biafra nation agitators, seeking the reinstatement of his revoked bail and his release from the custody of the Department of State Services (DSS).
The Judge stated that the same plea had previously been brought before her by Kanu and was dismissed on grounds of merit.
In her ruling on Kanu’s request, Justice Nyako emphasized that Kanu had violated the conditions of his earlier granted bail by absconding and leaving the country. Furthermore, she noted that the sureties who had stood for him in the previous bail application had applied to be discharged due to their inability to locate Kanu or determine his whereabouts.
The Judge asserted that Kanu’s only recourse now is to approach the Court of Appeal to exercise his right of appeal, rejecting his lead counsel’s argument that the Supreme Court had ruled against the revocation of his earlier bail. Justice Nyako clarified that she had reviewed the Supreme Court’s judgment and found no support for the lawyer’s claim.
Despite the court’s decision, Kanu adamantly refuses to stand trial before any Nigerian court, arguing that such action would contravene both Nigeria’s Constitution and international laws.
