The Economic and Financial Crimes Commission (EFCC) has been ordered by Justice Adegbola Adeniyi of the Federal Capital Territory High Court to produce detained former Governor of Central Bank of Nigeria, Godwin Emefiele or set him free.
The court, in an order following a Motion Ex-parte filed by the former CBN boss ordered Emefiele’s unconditional and immediate release should the EFCC fail to bring him to court on November 6.
Emefiele had filed a Motion Ex-parte, seeking his release from the custody of the EFCC pending the hearing and determination of the Originating Motion.
The court has fixed Monday, November 6, 2023 for the hearing of the substantive Motion on Notice, with the possibility to admit the embattled Emefiele to bail.
The applicant named the Federal Republic of Nigeria, the Attorney-General of the Federation, (AGF) the Executive Chairman of the EFCC, and the EFCC itself as the respondents.
Emefiele had in an ex-parte motion he filed before the court, sought an order to compel the EFCC to release him from custody, pending the determination of his fundamental right enforcement suit.
Alternatively, he prayed the court to grant him bail.
CRUX NEWS recalls that the immediate past CBN governor was last week arrested by the EFCC immediately after his release by the Department of State Services (DSS).
