Members of the legal team representing the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, have submitted a comprehensive list of judgements in his favor to the office of the Attorney General of the Federation, Lateef Fagbemi. The submission took place at the Federal Ministry of Justice in Abuja.
Barr Nnaemeka Ejiofor, the head of Kanu’s legal team, informed journalists on Thursday that these judgements, from both domestic and international courts, unequivocally direct the release of Kanu.
This action was taken in response to a statement by the AGF, indicating his unawareness of Kanu’s case and asserting that Kanu’s fate would be determined by the court.
Ejiofor further urged President Bola Tinubu to honor the various judgements and facilitate Kanu’s release.
On May 24, AGF Fagbemi remarked that the offence Kanu is accused of is complex and can only be resolved by a competent court of law. He also highlighted the distinction between Kanu’s case and that of Omoyele Sowore.
Earlier, Kanu’s lawyers filed a preliminary objection at the Federal High Court in Abuja, requesting Judge Binta Nyako to decline jurisdiction over the trial. The lawyers questioned the constitutionality of the laws underpinning the charges in Counts 1, 2, 4, 5, and 8, arguing for their dismissal.
However, Justice Nyako denied Kanu’s request for the reinstatement of his revoked bail and the transfer of his custody from the Department of State Services (DSS) to house arrest or prison custody.
Nnamdi Kanu has been in DSS custody since June 2021, following his arrest in Kenya and subsequent extradition to Nigeria, where he faces terrorism-related charges brought by the Federal Government.
