In a recent development, the Court of Appeal in Kano State has modified the 24-year sentence of atheist Mubarak Bala, reducing it to five years.
The saga began in April 2022 when a Kano State High Court in Audu Bako sentenced Bala, the President of the Humanist Association of Nigeria, to 24 years in prison on charges of blasphemy against Allah and Prophet Muhammad.
This case garnered widespread attention in 2020 when Bala was arrested at his Kaduna residence over alleged blasphemy and incitement.
After initially pleading guilty to charges of ‘causing a public disturbance,’ Bala later appealed the hefty sentence. According to a report, the Court of Appeal has now intervened, reducing his sentence to five years.
Bala’s legal representative, Mr. James Ibor, expressed gratitude, stating, “The court agreed with us that the sentence was against the law.” He also noted that further details would be provided upon the publication of the full judgment later in the week.
The legal team remains keen on understanding the court’s stance regarding Bala’s challenge over jurisdiction, despite his guilty plea. There are concerns raised by Humanists International, suggesting that Bala’s plea may have been made under duress.
On 21 February 2024, the Court of Appeal panel in Kano approved the regularization of Bala’s appeal, despite delays in document submission, and accepted written arguments from both the prosecution and defense.
The appeal was made on four grounds, including the lack of jurisdiction of the Kano State High Court, perceived bias of the judge, failure to accord Bala the benefits of a guilty plea, and misapplication of sentencing laws.
Humanists International has been vocal in support of Bala, asserting that he has been targeted for his peaceful exercise of rights to freedom of religion or belief and expression. They’ve urged the Appeal Court to overturn the trial Court’s judgment, quash Bala’s conviction, and secure his immediate and unconditional release.
