The Federal High Court in Lagos has issued an interim injunction preventing Ikeja Electric PLC and the Nigerian Electricity Regulatory Commission (NERC) from enforcing the tariff increase outlined in the April 2024 Supplementary Order for ‘Band A’ Feeders.
In a ruling on Tuesday, Justice Chukwujeku Aneke restrained the implementation of the tariffs published by Ikeja Electric on April 4, 2024, and the subsequent May 2024 Supplementary Order on Tariff Increase for ‘Band A’ Feeders, impacting Rida National Plastics Limited.
The court’s decision followed an ex parte application filed by Kemi Pinheiro (SAN), representing Rida National Plastics, with support from F. Giwa Esq and I. Aderibigbe Esq.
The injunction remains in effect pending Ikeja Electric and NERC’s compliance with Section 51 of the Electricity Act, 2023, and the resolution of the Motion on Notice for Interlocutory Injunction.
Rida National Plastics is the plaintiff in the case marked FHC/L/CS/1051/2024, while Ikeja Electric PLC and NERC are the defendants.

Additionally, Justice Aneke’s order temporarily prevents Ikeja Electric and NERC from demanding the payment of N20 million from Rida National Plastics, which was calculated based on the disputed tariff increase.
The order also bars the defendants from disconnecting the plaintiff’s electricity supply over non-compliance with the tariff.
The suit is adjourned until July 9, 2024, for the hearing of the motion on notice.
