A Bayelsa State High Court has delivered a landmark judgment in favour of youth activist Collins Opumie, awarding him N300 million in damages for his illegal arrest and detention by the Department of State Security (DSS) for over two years.
Activist Seeks Justice After Grueling Ordeal
Opumie’s ordeal began in 2020 when he was allegedly targeted by the Nigerian Agip Oil Company (NAOC). According to his claims, NAOC filed a petition with the DSS, leading to his abduction by the security agency in a manner described by his lawyer as “Gestapo style.”
Opumie faced a brutal reality. He alleges he was subjected to physical and mental torture, thrown into a vehicle, and transported to Abuja without his family’s knowledge. Denied access to medical care for the entire two-year duration of his detention, Opumie’s case highlights a concerning pattern of human rights abuses.
Legal Battle Launched in 2022
Determined to seek justice, Opumie filed a lawsuit (YHC/324/2022) in 2022. He initially sought a staggering N9 billion in damages for the severe violations he endured. His legal team argued for a declaration that his arrest, torture, and detention were not only illegal but also constituted false imprisonment and malicious prosecution. Additionally, they requested an injunction to prevent future harassment or attempts to detain Opumie based on NAOC’s actions.
Court Recognizes Wrongful Imprisonment
In his ruling on May 20, 2024, Justice Ebiyon Charlie acknowledged the severity of Opumie’s case. While the awarded N300 million fell short of the initial claim, the judge declared Opumie’s detention as “forceful imprisonment” and deemed him deserving of compensation.
Opumie Expresses Mixed Emotions
Reacting to the judgment, Opumie expressed a mix of emotions. Though not awarded the full amount sought, he acknowledged the court’s recognition of his suffering. He expressed gratitude to those who supported him, including traditional rulers and his lawyer, for advocating for the truth.
